Elena Papamichael successfully resists Solicitor General's Reference in mandatory minimum case

The Crown sought the mandatory minimum sentence of seven years for a 20-year-old defendant for his third Class A drug supply case. Elena Papamichael successfully persuaded the Crown Court to pass a sentence of only three years and two months, on the basis that it would be unjust in all the circumstances to impose the minimum term. 

The Solicitor-General intervened on the basis that the sentence passed was unduly lenient and applied to the Court of Appeal to increase the sentence to seven years.

Elena successfully resisted the application and the Court of Appeal refused to interfere with the sentence.
