Tom Wainwright secures acquittal for HS2 rebellion protestor after trial collapses due to CPS disclosure failures

Tom Wainwright of the Garden Court Chambers Protest Team was instructed by Hollie Collinge of Kellys Solicitors.

Tom represented Miriam Instone who was charged with Aggravated Trespass and Watching and Besetting having taken action to prevent HS2 engineers from cutting down a 200 year old tree and endangering the wildlife within. After the Crown failed to properly serve or disclose evidence relating to the lawfulness of the activity taking place, the case was dismissed following submissions by the defence on the unfairness of the proceedings, given the state of the prosecution case.
