R (Buckinghamshire County Council) v the Royal Borough of Kingston upon Thames and others [2010] EWHC 1703 Admin

Stephen Knafler QC represented Kingston, supported by the Official Solicitor, on behalf of a woman with a learning disability, SL, and the National Society for Epilepsy, in successfully defending proceedings brought by Buckinghamshire County Council. The Judge, Mr Justice Wyn Williams, held that Kingston had not been under a legal duty to consult with Buckinghamshire before helping SL move out of care home accommodation managed by the National Society for Epilepsy and paid for by Kingston, and into a supported housing arrangement. Thus, Buckinghamshire was obliged to undertake responsibility for SL. The Judge refused Buckinghamshire's application for permission to appeal to the Court of Appeal.
