The Immigration Act 2016 received royal assent on 12 May 2016 and makes significant amendments to schedule 3 of the Nationality Immigration and Asylum Act 2002 ('NIAA 2002') such that entitlements of migrant families and care leavers to section 17 and section 23C / 23CA support under the Children Act 1989 respectively will be restricted in certain circumstances.

The Government indicated in the debates on the Bill that draft regulations and draft statutory guidance will fall to be consulted. The new provisions are unlikely to come into force until the consultation process has been completed.
