Samuel Erinle v Chief Constable of Merseyside Police

Sarah Hemingway represented Samuel Erinle in successfully claiming damages for assault and malicious prosecution against the Merseyside police. In a five-day trial, before HHJ Gore QC in the Liverpool County Court, the jury found unanimously that Mr Erinle had been punched in the face by an officer while handcuffed in the back of a police car. Subsequent to that arrest he was prosecuted for racially aggravated assault and assault against a police officer but was acquitted after a crown court trial. He claimed that the police had falsified their accounts in an attempted 'cover up' and the jury found that he had been prosecuted for a reason other than the proper ends of justice. Mr Erinle will receive a substantial award.
