Keir's client, Mr Bushati, pleaded guilty at the plea and trial preparation hearing (PTPH) and got 25 per cent credit for his guilty plea. Keir persuaded the Court of Appeal that Mr Bushati should have received the full discount.
This is an important case as it provides an example of how the discretion under section F of the Reduction in Sentence for a Guilty Plea Definitive Guidelines should be utilised to allow a defendant the third off discount despite pleading guilty at the PTPH hearing. Mr Bushati's sentence was reduced by 7 months.
