The guidance of the British HIV Association is only intended to be 'best practice' and therefore could not be treated as a legal minimum standard for the treatment of detainees who are HIV positive. Click here for the full judgment.

NA (Iran) v Secretary of State for the Home Department [2011] EWCA Civ 1172
18th October 2011

In a dismissed appeal against a 3rd country removal to Latvia of an Iranian national and her daughter, the Court of Appeal was critical of the UKBA's policy guidance formulated in response to S.55(3) of the Borders Act 2009. In giving the lead judgement, Sir Stephen Sedley noted at para: 34: "What is conspicuously lacking in the policy,... is any slip-road for cases in which it has become apparent since the process was initiated that there is now a real risk of violating a Convention right if return is proceeded with." Introduced a one day course for those newer to Immigration Law wishing to accredit at entry level. The aim of this course is to give delegates sufficient knowledge for Level 1 assessments with the OISC focussing on the OISC's core requirements.
