David Renton acting in Employment Appeal Tribunal case on blacklisting

David Renton is currently appearing in the Employment Appeal Tribunal (EAT) hearing into blacklisting by Carillion (JM) Ltd - previously John Mowlem Ltd.

The Claimant Dave Smith was subjected to blacklisting by Carillion (JM) Ltd. A previous Tribunal has found that Carillion (JM) Ltd added false information (including false allegations that he had taken part in acts of industrial sabotage) to a database controlled by the Consulting Association.

The sole issue in the appeal is whether an agency worker such as Mr Smith can be protected by employment laws which are framed around the protection of employees, when as a matter of ordinary employment law, most agency workers are not employees.

On the first day of Mr Smith's hearing, the construction industry announced that it was planning to set up a fund to compensate blacklist victims.

Dave Smith's case has received extensive media coverage, including on the Today programme, Newsnight and Channel 4 News.
