David Emanuel succeeds at the Court of Appeal in sentence challenge

The Court of Appeal has quashed a 12-year custodial sentence for rape and extended the time in which to appeal by 810 days.

David was approached by the appellant after his trial advocate advised him he had no grounds to appeal. Despite the Single Judge refusing leave to appeal and despite the appeal being nearly three years out of time, the Full Court today held that David’s arguments had merit and reduced the sentence by two and a half years and extended the time to appeal accordingly.
