Court of Appeal grants permission to appeal on whether points of fact are to be settled in the county courts

In Bubb v Wandsworth LBC the Court of Appeal has granted permission to appeal to Stephen Knafler QC, together with Toby Vanhegan of counsel, so as to enable the Court of Appeal to determine whether, when hearing a homelessness appeal, the county court has to decide questions of "pure fact" for itself, for example, as to whether or not statutory information or written notices were actually received by the homeless application. The case will be a test case on the scope of judicial review, appeals on a point of law and common law proportionality.
