The Court of Appeal has allowed the appeal of YM against his deportation, consequent on a number of criminal convictions, including attending two terrorist training camps contrary to section 8(2)(a) of the Terrorism Act 2006.
The Upper Tribunal should have applied the 2012 Immigration Rules to YM’s case and, if it had, YM may have succeeded under the Rules, properly construed.
