The defendants took a preliminary point on the ambit of the criminal offence in S.92 Trade Marks Act 1994, which was then appealed and culminated in a ruling from the Supreme Court, who remitted the case back to the Crown Court for trial. On 30 October 2017 at St Albans Crown Court, following a week of further legal argument, the prosecution offered no evidence against all defendants.
