Understanding substantive gender equality and framing tax/benefit evidence in discrimination cases: How to avoid a rerun of R (SG) v Work and Pensions

We are intensely grateful to have the opportunity to hear Professor Kathleen Lahey of Queen’s University Faculty of Law, Canada explain how the analysis of gender equality relied on by the UK Supreme Court in R (application of SG) v Sec. State for Work and Pensions, [2015] UKSC 16, falls short of human rights standards. She will demonstrate how the evidence in this case can be developed and presented to reveal the gendered impact.

• Gender equality - the difference between formal and substantive equality
• The UK Supreme Court's failure to keep up to date on contemporary equality discourses
• “Microsimulation” -  a modelling technique that operates at the level of individual units such as persons and households
• How microsimulation of Government demographic, tax, and benefit statistics can expose gender impacts
• How using this technique can bring realistic data to bear on complex fiscal issues
