This seminar will provide a detailed look at the law and practice on homelessness following the most important statutory changes in a generation.

With effect from 3 April 2018, the Homelessness Reduction Act 2017 has radically overhauled the law on homelessness. Connor Johnston and Tessa Buchanan, co-authors with Liz Davies and HHJ Luba QC of the forthcoming fifth edition of Housing Allocation and Homelessness, will provide a practical and comprehensive guide to the complex new system. The seminar will also look at the latest case-law in this area and provide an in-depth analysis of priority need as courts grapple with the implications of Panayiotou v Waltham Forest.

This seminar will cover:

  • An overview of the amendments made to the Housing Act 1996 by the Homelessness Reduction Act 2017
  • A discussion of how the HRA 2017 is operating in practice
  • An analysis of recent homelessness decisions, including R (Sambotin) v London Borough of Brent, Lomax v Gosport Borough Council, and XPQ v Hammersmith and Fulham LBC
  • An in-depth look at priority need, including a discussion of its relevance post-HRA 2017; an analysis of interesting County Court decisions on vulnerability and medical advisers; and best practice recommendations for reviews and appeals.
