Pryce v London Borough of Southwark and Secretary of State for the Home Department (Intervener) (2012)
Ms Pryce was unlawfully present under domestic law but the sole carer of her British citizen children. She was successful in establishing that she has an EU right of residence under Article 20 TFEU, following the case of Zambrano. This enabled her to be eligible for homelessness assistance because she was not a person subject to immigration control and was a person with a right of residence. This right was not excluded by the Allocation of Housing and Homelessness (Eligibility) (England) Regulations 2006.

Represented a tenant who was awarded £8100 damages for disrepair (water penetration), being 3/5 of rent for a 15 month period. The tenant also recovered damages for the landlord's failure to protect her deposit.

Southend-on-Sea Borough Council v Robert Armour (2012)
Important example of a defence relying on the right to respect for the home in Article 8 of the ECHR succeeding. On an appeal to the High Court the dismissal of a claim for possession against an Introductory Tenant on the basis that eviction would infringe his human rights was upheld. The High Court confirmed that the time when facts need to be assessed under Article 8 is the time of the hearing of the possession.

Human rights challenge brought on behalf of two Romani Gypsies who faced a significant shortfall in their rent due to the way housing benefit is calculated on privately owned caravan sites. The Court held that the differential treatment of Romani Gypsies under the housing benefit scheme was objectively justified.

Ms Pryce was unlawfully present under domestic law but the sole carer of her British citizen children. She was successful in establishing that she has an EU right of residence under Article 20 TFEU, following the case of Zambrano. This enabled her to be eligible for homelessness assistance because she was not a person subject to immigration control and was a person with a right of residence. This right was not excluded by the Allocation of Housing and Homelessness (Eligibility) (England) Regulations 2006.

Important example of a defence relying on the right to respect for the home in Article 8 of the ECHR succeeding. On an appeal to the High Court the dismissal of a claim for possession against an Introductory Tenant on the basis that eviction would infringe his human rights was upheld. The High Court confirmed that the time when facts need to be assessed under Article 8 is the time of the hearing of the possession.

The Claimant was a 72-year-old resident of a site at Dale Farm in breach of planning law. The council proposed to carry out a direct action eviction. She brought a claim for breach of the Human Rights Act 1998 and sought an interim injunction to prevent the eviction. The High Court refused the injunction but granted a temporary stay for 7 days to allow the council to review the latest medical evidence about the claimant.
