Our Property Team offers advice and representation across a wide range of property law to individuals, businesses and institutions.

• issues for leaseholders: all Leasehold Valuation Tribunal disputes (enfranchisement, lease extension, right to manage, and service charge disputes) right to buy and right of first refusal, lease variations
• disputes about title to property and other property rights: trusts of land including Trusts of Land and Appointment of Trustees Act 1996, proprietary estoppel and similar claims
• commercial landlord and tenant issues: Landlord and Tenant Act 1954 disputes including advising on security of tenure and contracting out, termination and renewal; compensation, alterations and dilapidations, breaches of covenant, rent review assignment, renewals, rent review, and service charges issues, and disclaimer, forfeiture or surrender

Notable Cases

• R (Diep) v Land Registry [2010] EWHC 3315 (Admin) An adverse possession case where the claimant challenged the grant of possessory rather than absolute title by the Land Registry (Michael Paget)
• Broadway Market Investments v Grant [2006] EWCA Civ 1709, [2007] 1 P&CR 18, [2007] L&TR 11 concerning the border between business tenancies under Part 2 of the Landlord and Tenant Act 1954 and assured tenancies under Housing Act 1988 (David Watkinson)
• Kay v Lambeth LBC [2006] UKHL 10, [2006] 2 AC 465 the leading case on rights of sub-tenants where the intermediate landlord was granted a licence rather than a tenancy following Bruton v London and Quadrant Housing Trust [1999] UKHL 26; [2000] 1 AC 406; [1999] 3 All ER 481 itself the leading modern authority on tenancy by estoppel (David Watkinson appeared in both cases).
