Mediation

Why Mediate?

If you are in dispute with a person, or say, a business, you know that you can go to court to assert your rights. But this can be expensive, stressful and take up a good proportion of your life. You may wish to consider mediation as a means of resolving your dispute where, for example, privacy is important or communication has broken down. This is when you may wish to consider mediation as a means of resolving a dispute.

What is Mediation?

Mediation is a process whereby parties are given the opportunity to come to an agreement with the help of a trained mediator who is there, not to judge or express any opinion, but to facilitate the parties reaching a mutually satisfactory resolution. The process is common in many jurisdictions and is expanding in the United Kingdom.

What are the advantages of Mediation?

Cost, freedom from stress, saving in time and finality! The process is very cheap compared to litigation. It can usually be conducted within a working day. If an agreement is reached, that is the end of the matter: no appeals, no further proceedings. The parties are free to carry on with their lives.

Who are Mediators?

Mediators in the sense we mean it are people who are qualified and recognized by the professional bodies as being equipped with the skills to conduct mediations. They need not be lawyers but the service provided by Garden Court is by barristers who otherwise are engaged in advising and representing people. Our mediators practice in a number of different areas of law. Some of them sit as judges in the law courts and tribunals and some of them are Queen's Counsel. What they have in common is that they also have the skills to neutrally facilitate a positive outcome for the parties in a dispute.
