Garden Court Chambers invites tenancy applications from busy practitioners at all levels of call to join our Education Law Team.

Members of our Education Law Team provide sector-leading expertise in school exclusion, discrimination and special educational needs matters. Members are instructed in many of the most significant High Court and appellate cases in this area. Recent cases include R (TZA) v A School [2023] EWHC 1722 (Admin), the leading High Court case on the Public Sector Equality Duty (‘PSED’) and school exclusions; R (AI) v London Borough of Lambeth and Secretary of State for Education [2023] EWHC 2088 (Admin) concerning PSED-compliance in securing special educational provision for a transgender young person; and R (CR) (by their litigation friend, TI) v Director of Legal Aid Casework and Lord Chancellor [2023] EWCA Civ 717, which led to the expansion of legal aid eligibility for Looked After Children in SEND Tribunal proceedings.

In partnership with other organisations, we founded and coordinate the School Inclusion Project (‘SIP’), a cross-sector forum to facilitate legal representation and address the systemic discrimination in school exclusions. 

 Members of the team frequently write and provide training, sit as Tribunal judges and are on the executive committee of the Education Law Association. We also regularly hold successful events and were the exclusive sponsors of the Legal Action Group Education Law Conference in 2022 and 2023.

Our growing Education Law Team includes several leading KCs as well as juniors ranked in the Education Law categories in Chambers and Partners and the Legal 500. We are committed to becoming the leading claimant-focused Education Law set, and welcome applications from outstanding practitioners with expertise in Education Law who are aligned with our ethos and a good fit for our chambers.

New members of the Education Law Team would be supported to develop their practices in complementary areas such as Community Care Law and Court of Protection, in which we are also recognised as a leading set in Chambers & Partners and Legal 500.
