Practice

Marie's practice covers a wide range of private law and public law proceedings.

Private Law
Marie regularly appears on behalf of parents and extended family members in private law children matters. She has experience in the following areas:

  • all Section 8 CA 1989 orders: contact, residence, shared residence, prohibited steps and specific issue
  • relocation cases
  • applications for leave to remove a child from the jurisdiction
  • domestic violence and Re L fact-finding hearings
  • allegations of physical, sexual and emotional abuse
  • drug and alcohol misuse
  • mental health issues
  • enforcement applications

Domestic Violence and the Family Law Act 1996
Marie acts on behalf of both victims and perpetrators of domestic violence in respect of:

  • Applications for non-molestation orders, occupation orders and transfer of tenancy
  • Committal proceedings


Marie recently delivered a lecture to public sector housing advisers in East London regarding the family law and housing law options available to survivors of domestic violence (East London Housing Partnership March 2010)

Public Law
Marie represents local authorities, parents, extended family members and children in care proceedings, and placement order applications.

Marie also has experience in respect of the following:

  • Applications for the discharge of a care order
  • Applications for contact with children in care
  • Applications for residential assessments
  • Applications for leave to oppose the making of adoption orders
  • Applications for Special Guardianship order
  • Disputes regarding the designation of a local authority for the purpose of administrating the care plan and care order

Background

Before joining Garden Court, Marie worked for a number of years as a housing caseworker in both a private legal practice and a specialist private sector housing advice service in central London. She advised and assisted tenants and families surrounding issues of homelessness, overcrowding, security of tenure, disrepair, housing allocation schemes, rent arrears, unlawful eviction, and welfare benefits. She also gained experience of defending possession proceedings at the county court under the duty representation scheme. Marie's employment prior to joining Garden Court provided her with an excellent opportunity to gain a developed understanding of the cultural and socio-economic issues many families face, which has only served to further her holistic understanding of these complex areas, and to heighten her lifelong commitment and passion for social justice.
