Practice
Emma Favata now has an exclusively civil law practice focusing principally on civil claims against the police and public authorities and inquests. Judicial review and proceeds of crime act proceedings constitute a smaller part of Emma's practice. Emma has specialised in false imprisonment, malicious prosecution, trespass to the person and property and misfeasance in public office. She has advised extensively on these torts as well as conducting jury and judge only trials. Emma also specialises in inquest law particularly deaths in custody. She has also represented bereaved families in inquests involving medical negligence, police pursuit and careless driving by police officers. She has represented families at inquests involving both juries and coroners sitting alone. Emma has developed a specialisation in protester cases having successfully represented, amongst others, Brian Haw of Parliament Square in Westminster City Council's first attempt to eject Brian from his site through injunction proceedings before the High Court. Emma Favata has a strong academic background in International and European Human Rights Law with post-graduate qualifications from universities in Britain and France. On completing her second-six pupillage at Garden Court, where she was trained in criminal and civil law (notably civil actions the police) she became a tenant. During her first few years of practice Emma developed her civil practice alongside a strong criminal practice ranging from junior briefs in serious fraud and drugs trials to street robbery and political protestors. Amicus Committee member. An Andrew Lee Jones Fund Scholar, Emma undertook an internship with the Public Defenders in Chicago and worked on Privy Council Death Penalty Appeals in Britain. She wrote US Death Penalty Practice and International Law (Amicus Journal -June 2000) and Death Penalty Practice: a gap in the United States' Human Rights Policy (Andrew Lee Jones Fund Scholar Paper).
