Background

Unusually Bansi’s practice spans the whole breadth of Family Law, but crucially she has a depth of specialisation within in each of her practice areas. Bansi is particularly aware of and able to deal with the very specific challenges faced by ethnic minority communities within Family Law litigation. Her knowledge of South-East Asian languages and the social, cultural and financial practices of the Asian subcontinent, allows her to deal with these cases sympathetically yet effectively.

Practice

Private Children Law

Bansi is briefed on all forms of private law proceedings representing parents and children, areas of expertise include:

  • All forms of Section 8 Children Act 1989 applications, including matters involving allegations of physical or sexual abuse;
  • Matters relating to children of mixed race parents, or involving a foreign element in residence and contact issues;
  • Cases where psychiatric evidence relating either to parents or children is required.

Public Children Law 

Bansi’s Public Law work covers instructions from local authorities, parents and other parties and guardians ad litem with cases that include;

  • Complex medical evidence;
  • Confidentiality and disclosure;
  • Applications in which issues arise in relation to foreign jurisdictions, immigration or where placement of children outside the jurisdiction is proposed;

International Family Law 

Bansi completed her pupillage at the set of Henry Setright QC, with a specialisation in child abduction and forced marriage. She has experience of;

  • All aspects of international child disputes including abduction to and from non-convention countries;
  • Enforcement and registration of orders made in foreign countries;
  • "Mirror orders" in countries where no international treaty is in force;
  • Brussels II Regulations;
  • Forced marriage cases in the Indian-subcontinent.

Finance and Divorce

The spectrum of financial cases which Bansi undertakes is wide, and ranges from disputes where the assets available for the court allocation are insufficient, or only just adequate to provide for the parties to those where the parties’ means are of substantial value. She has particular expertise in;

  • Cases with complicating factors such as an international dimension, dowry cases and disputes involving insolvency, bankruptcy and liquidation;
  • Applications under Schedule 1 of the Children Act 1989;
  • Cases brought under the Inheritance (Provision for Family and Dependants) Act 1975;
  • Applications pursuant to the Trusts of Land and Appointment of Trustees Act 1996;
  • The Civil Partnership Act 2004; and
  • Judicial separation and nullity.

Domestic violence

Bansi is able to provide representation and advice in relation to injunctive relief under Part IV of the Family Law Act 1996 and the Protection from Harassment Act 1997.

  • Scholarship to represent Middle Temple as an ambassador in India. Bansi was shown around legal India from New Delhi through to Bangalore.
